Suit by appellant against appellees upon a note and mortgage executed by the appellee McKnight, and his wife Mary Jane McKnight, to the appellant. The note and mortgage were given May 1st, 1869, to secure the payment of $950, payable one year after date, with interest at ten per cent., and attorney’s fees, and waiving the benefit of appraisement laws. It is alleged that the mortgage was recorded May 15th, 1869.
