DAY, Circuit Judge.

This cause was begun in the circuit court of the United States for the district of Kentucky by tlie plaintiffs, Buckner & Co., to recover damages from the defendant insurance company for alleged libel. The company, organized under the laws of the state of New Jersey, was engaged in carrying on the business of *223fire insurance in the slate of Kentucky. Its manager was one K. H.
