The defendant-appellant Gilbert Pacheco appeals from the judgment of the first circuit court, the Honorable Victoria Marks presiding, convicting him of and sentencing him for the offenses of escape in the second degree, in violation of Hawai'i Revised Statutes (HRS) § 710-1021 (1993), 1 and drinking in a public park, in violation of Revised Ordinances of Honolulu (ROH) § 40-1.2(a) (1991). 2 On appeal, Pacheco claims that prosecutorial misconduct tainted his jury trial and, thus, warrants reversal of the circuit court’s judgment of conviction and…
