The procedings in this ease were instituted by a petition filed in the court below by the department of property and supplies of the Commonwealth, agreeably to the provisions of the Act of July 15, 1919, P. L. 976, and the Administrative Code of April 9, 1929, clause (f), section 2402, P. L. 177, 306, as amended by so much of section 1 of the Act of June 1, 1931, P.
