Appeal from an order overruling a demurrer to the complaint, the trial court having certified that the question presented was important and doubtful.

*305The action was brought by plaintiff in behalf of himself and other taxpayers in the city of Eveleth to compel the mayor and councilmen to restore to the city $74,601.54, alleged to have been wrongfully appropriated out of the public funds of the city by these officers.
