This appeal arises out of an action by an excavating sub-contractor, Highland Construction Company (hereinafter Highland), against the general contractor, LaMar D. Stevenson Construction Company (hereinafter Stevenson), Stevenson’s bonding company, United States Fidelity and Guaranty Company (hereinafter USF&G), and Shell Oil Company (hereinafter Shell). Highland alleged that it suffered damages as a result of defective construction plans and unreasonable delays by Stevenson and Shell in the performance of their work.
