MEMORANDUM AND ORDER

The plaintiff, Ramon Lopez, initiated this action against his former employer, defendant Sears, Roebuck & Company (“Sears”) seeking damages along with declaratory and injunctive relief for alleged discriminatory employment practices. The action was filed pursuant to 42 U.S.C. § 2000e et seq. of the Civil Rights Act of 1964, as amended by the Equal Employment Opportunity Act of 1972 (Title VII), the Thirteenth Amendment to the Constitution, 42 U.S.C. § 1981, and 42 U.S.C. § 1988.
