REYNOLDS, District Judge.

This is an appeal from the dismissal with prejudice of plaintiff-appellant Dan Archie’s first amended complaint. For the reasons hereinafter stated, we affirm in part and reverse in part.

*213Archie is a black man who was employed as a dock worker by respondent ABC Trans National Transport (“ABC”) to load freight onto trucks. He was discharged on January 31, 1975, for allegedly improperly tallying freight.
