J.F. White Contracting Company entered into a public construction contract to replace, remove, or clean culverts running beneath active commercial rail lines in preparation for South Coast Rail commuter train traffic. The contract with the Massachusetts Department of Transportation (“MassDOT”) had an amended maximum obligation amount of $20.3 million. After essentially completing its work, J.F.
