PLATT, District Judge.
The grand jury returned an indictment against Walter Gale Thomas for violation of Sec. 462, Title 50 U.S.C.A.Appendix. It alleged he refused to comply with the order of his selective service board to perform certain civilian work contributing to the maintenance of national health, safety or interest at the University of Chicago Clinics, Chicago, Illinois. Mr. Thomas waived jury trial as provided by Rule 23(a) of Fed.Rules Crim.Proc. 18 U.S.C.A.
