Commonwealth v. Riche
Massachusetts Appeals Court
1Opinion of the CourtKaplan, J.
After jury trial in Superior Court, the defendant Riche was convicted of trafficking in cocaine in an amount of more than 28 but less than 100 grams, G. L. c. 94C, § 32E(b). He appeals, complaining that the court erred in denying his pretrial motion to exclude the cocaine from evidence.
Similar suppression motions were filed on behalf of Jerry Dessalines and Heather Rizzotto, persons also involved in the same episode, and there was a single hearing on the three motions. The motions were denied. Riche was tried separately, and convicted.
