This action was tried in the district court on an agreed statement of facts, and ten questions were submitted to the court for determination. It appears that the trustees of the village of Coeur d’Alene, in the summer of 1906, determined to avail themselves of the provisions of the act of February 24, 1905, authorizing cities, towns and villages to construct and maintain sewerage systems, etc., and accordingly passed an ordinance creating and establishing “local sewerage improvement district No. 1” of the village of Coeur d’Alene.
