This action is in the nature of a creditor’s bill to enforce payment by defendant of its unpaid subscription to the stock of the Venice Hotel Company, a corporation. Plaintiff, in 1908, brought its action against the Venice Hotel Company, a corporation. The Venice Hotel Company appeared and defended under a verified answer filed by Abbott Kinney, its president. The cause was tried and resulted in a judgment for plaintiff. A notice of intention to move for a new trial was given, but the motion was not prosecuted and the judgment became final.
