This matter, before the court on defendant’s motion to dismiss; plaintiffs motion to lift the stay of discovery; and plaintiffs mor tions to dismiss part of Count V and Count VI without prejudice, involves an indefinite-quantity construction contract (IDQ contract) between Schweiger Construction Co. (Schweiger) and the General Services Administration (GSA). Schweiger was to provide construction services in GSA owned or leased buildings in Kansas City, Missouri.
