GRODIN, J.

Defendant David Wendell Ruggles was charged with (1) robbery (Pen. Code, § 211) with use of a firearm (Pen. Code, § 12022.5) and (2) possession of a firearm by an ex-felon (Pen. Code, § 12021). The information was amended to charge six prior convictions and the case was consolidated with a second case in which a single count of robbery was charged. Defendant pleaded not guilty, denied the priors, and moved to suppress evidence (Pen. Code, § 1538.5). Following hearing and denial of the motion to suppress, a plea bargain was negotiated whereby defendant withdrew his not guilty…
