Following a jury trial, 1 defendant-appellant Casey Duncan was convicted of theft in the first degree, in violation of Hawaii Revised Statutes (HRS) § 708-830.5 (1993). On appeal, Duncan contends that the trial court: (1) made erroneous evidentiary rulings with respect to the testimony of certain witnesses; (2) erred in denying his motion for withdrawal and substitution of counsel; (3) erroneously instructed the jury regarding the presumption of innocence; and (4) abused its discretion in imposing a ten-year term of imprisonment.
