In an action, inter alia, for a declaratory judgment and injunctive relief, the defendant Incorporated Village of Free-port appeals from an order of the Supreme Court, Nassau County (DiNoto, J.), dated June 28, 1994, which denied its motion for summary judgment dismissing the complaint against it and permitted the plaintiffs to serve a notice of claim nunc pro tunc.
Ordered that the order is reversed, on the law, with costs, the motion is granted, the complaint is dismissed insofar as asserted against the defendant Incorporated Village of Freeport, and the action against the remaining…
