Appeal from an order of the district court denying plaintiff’s motion for a new trial after a verdict for defendant.
The accident out of which this action arises occurred on August 1, 1947, at a point on a new grade some 750 to 1,500 feet south of the intersection of highways Nos. 76 and 44 near the city of Caledonia. Prior to the road construction out of which arose the events upon which this action is based, highway No. 44 ran in an east-west direction through the city of Caledonia.
