This is an appeal from an order of the municipal court of St. Paul denying plaintiff’s motion for a new trial.

On August 13, 1951, at approximately eight o’clock in the morning, defendant Harold W. Griffin was driving his automobile in an easterly direction on Kellogg boulevard in St. Paul. Following him was an automobile driven by the defendant Ray E. Engel. To the rear of the Engel automobile was one owned and driven by the plaintiff, John Ryan.
