This matter is before the court on cross motions for summary judgment brought by Robert Powell (“Powell” or “plaintiff’), Tyler Papworth (“Papworth”) and Union Pacific Railroad Company (“UP”) and Robert Kline (“Kline”) (collectively, “defendants”).
