Plaintiff married defendant in 1939, and a child was born of such marriage. In June of 1948, after discovering that defendant had entered into another marriage in April of 1948, she instituted an action for separate maintenance, alleging extreme cruelty. Defendant filed an answer in which he denied that the parties were ever validly married. It is conceded that when defendant married plaintiff in 1939 he was in fact married to, and undivorced from, a first wife.
