— This is a consolidated action wherein the parties are seeking an adjudication of their rights under a partnership agreement. The appellant seeks dissolution of the partnership, and distribution to him of his claimed share of the net assets. The respondents, who are the remaining partners under the agreement, seek to enforce by injunction a covenant not to compete, which was contained in the partnership agreement; and to recover damages for alleged breach of this covenant.
