Appeal from an order sustaining a demurrer to the complaint on the ground that it .failed to state a cause of action. As alleged, these were the material facts: On November 15, 1918, Joseph Friedman and Ms wife entered into a written contract with the plaintiff and one Granstrom for the sale to them of the Park Theatre in the city of St. Paul. By the terms of the contract, the vendors agreed to sell and the vendees agreed to buy the property for $65,000, $10,000 to be paid as earnest money when the contract was executed, $30,-000 on or before 11 a. m. on March 1, 1919, and $25,000 by…
