GORTON, District Judge.

The plaintiff, John P. Charters (“Charters”) alleges violations of the Employment Retirement Income Security Act of 1974, 29 U.S.C. § 1002 et seq., (“ERISA”) on behalf of the 401(k) plan for which he is a trustee and on behalf of all trustees and administrators of all “employment benefit plans” under ERISA that owned variable annuity contracts from the defendant, John Hancock Life Insurance Company (“Hancock”).
