Appellee, TCP LB Portfolio I, L.P., sued appellant, Houston Bellaire, Ltd., seeking a declaration that it was entitled to an easement by estoppel, implication, prescription, and necessity through property owned by Houston Bellaire, and for Houston Bellaire’s tortious interference with existing and prospective business relationships. Prior to trial, TCP obtained a temporary injunction enjoining Houston Bellaire’s construction of a fence that blocked the alleged easement.
