OPINION

COFFIN, Circuit Judge.

Plaintiffs have filed a civil rights action, pursuant to 42 U.S.C. § 1983, on behalf of themselves and others similarly situated, Fed.R.Civ.P. 23(b) (2), seeking injunctive relief, damages, and a declaratory judgment, pursuant to 28 U.S. C. § 2201. Jurisdiction is invoked under 28 U.S.C. §§ 1331, 1340, 1343(3), and a three-judge district court has been convened, pursuant to 28 U.S.C. § 2281. King v.
