MEMORANDUM OF DECISION
GARRITY, District Judge.
This is a civil rights action pursuant to 42 U.S.C. § 1983 in which plaintiff recipients of Aid to Families with Dependent Children (AFDC), on behalf of themselves and others similarly situated, challenge on constitutional grounds one aspect of the administration of the AFDC program by the defendant Commissioner of the Massachusetts Department of Public Welfare. Jurisdiction lies under 28 U.S.C. §§ 1331 and 1343 (3) and a three-judge district court was convened pursuant to 28 U.S.C. § 2281. The parties filed a stipulation of facts, affidavits,…
