Facts

This is a diversity action by the plaintiffs-obligees of a guaranty signed by defendants as collateral security for a loan by plaintiffs to Twin Lakes Village, Inc. The instant motion is for an attachment of personal and real property owned by defendants.

On April 10, 1972, plaintiff Mortgage Trust of America made a $6 million construction loan to Twin Lakes Village, Inc., a Nevada corporation doing business for several years prior to this transaction. This loan was secured by a deed of trust issued by Twin Lakes. Subsequently, an additional…
