This suit was'brought by plaintiff: below against the defendant to recover damages for personal injuries. The trial resulted in verdict and judgment in plaintiff’s favor for the sum of $16,(300. Prom this judgment there was an appeal to the court of civil appeals, in which court. the judgment was affirmed. The case is before us upon petition for. writs of certiorari. No question is made upon the amount of the verdict. The sole question for our consideration is whether plaintiff, has proven his case in such a degree of certainty as to have it decided by the jury.
