RICHARDS, J., pro tem.

The plaintiff in this action sought to have the defendants enjoined from the further use of a certain trade name and slogan in the city of San Diego, to the use of which the plaintiff claimed to be exclusively entitled. The trial court granted the defendants’ motion for a nonsuit at the close of the plaintiff’s case and thereupon ordered and entered its judgment in the defendants’ favor. It is from such judgment that this appeal has been taken.
