Plaintiff alleged that in the year 1896, in the city of Los Angeles, he established the business of moving, hauling, trucking and storing. To this business he gave the name of “Los Angeles Van, Truck & Storage Company.” In 1902 he made application to the state of California to have that name registered and trademarked, and on the thirteenth day of August, 1902, there was issued to plaintiff a certificate by the secretary of the state of California “granting said R. H. Dunston the sole and exclusive right to use and appropriate said name of Los Angeles Van, Truck & Storage Company to his said…
