The defendant, Carlos Jimenez, appeals from a judgment of conviction on two counts of first-degree sexual assault. The defendant had been accused by his sister-in-law, Mary,1 of sexually assaulting her while she was too intoxicated to resist. The defendant raises three issues on appeal. First, the defendant argues that the trial justice erred in denying his motion to suppress the oral and written statements he made to the police.
