On November 23, 1963, in the Middle-sex Superior Court, a jury found the defendant guilty of murder in the first degree, of Bessie Goldberg, of Belmont, with a recommendation that sentence of death not be imposed. The trial was subject to G. L. c. 278, §§ 33A to 33G, as amended. The defendant on this appeal has argued only the assignments of error discussed below.
