This is an election contest prosecuted under the provisions of sections 1111 et seq. of the Code of Civil Procedure.

At the general election in the year 1900 appellant and respondent were rival candidates for the office of supervisor in the fifth district of Los Angeles County. As a result of the official canvass, respondent was declared elected, and appellant thereupon filed his contest, based upon various grounds, requiring a recount of the ballots.
