I. INTRODUCTION
Defendant, Liberty Mutual Insurance Company, has brought this motion before the Court, pursuant to Rule 56 of the Federal Rules of Civil Procedure, seeking summary judgment on plaintiffs failure to prove the existence and contents of certain missing insurance policies. (Docket Item [“D.I.”] 343.) Plaintiff, Remington Arms Company, in responding to defendant’s motion, has requested permission to move for summary judgment in its favor on the same issue.
