This action was brought by W. J. McKenna to recover on an indemnity policy of insur*29anee issued by the International Indemnity Company, covering tbe use of an automobile owned by tbe plaintiff. While the policy was in force, an accident occurred whereby one Campbell was injured while the plaintiff was using the automobile. Campbell sued McKenna and wife on account of the accident. The defense in that suit was tendered to the indemnity company and declined by it.
