Appellant appeals from the judgment of the Circuit Court rendered against it in favor of appellee in the sum of $8,000, in an action on the case for damages resulting from the death of appellee’s intestate. The action is based upon the Act of Congress of April 22, 1908, as amended April 25, 1910, entitled “An Act Belating to the Liability of Common Carriers by Bail-road to their Employees in Certain Cases,” commonly called Federal Employers’ Liability Act.
