delivered the opinion of the court.

Appellee, as administrator of the estate of Mayo Earl Sutton, deceased, brought an action on the case against appellant to recover damages for the death of said deceased. The trial resulted in a verdict finding appellant guilty and assessing the damages at the sum of $8,500. Judgment was rendered on this verdict, which is sought by this appeal to be reversed. The suit is based upon the Federal Employers’ Liability Act, and was tried upon the issues presented by the third, fourth, fifth, seventh and eighth counts of the…
