Defendants petition for review of our opinion reversing the trial court’s dismissal of plaintiffs claim for intentional infliction of emotional distress under ORCP 21A(8). 102 Or App 343, 794 P2d 454 (1990). We treat the petition as one for reconsideration, ORAP 9.15(1), allow it and adhere to our opinion.
Plaintiff sued for intentional infliction of emotional distress and defamation. The trial court entered a judgment of dismissal with prejudice as to the emotional distress claim under ORCP 21A(8), after which plaintiff voluntarily dismissed her claim for defamation, without prejudice. She…
