This suit was brought by V. M. Duke and wife against John S. Stewart, P. H. Briant, D. F. Boyles, W. A. Myrick, J. W. Oliver, F. E. Creale, H. T. Straiti, E. F. Simms, E. F. Simms & Co., Magnolia Petroleum Company, and tbe Texas Pure Oil Refining Company, to cancel an oil lease executed by appellants to John S. Stewart, who beld tbe same for the benefit of himself and P. H. Briant, and assignments made by Stewart and Briant and their assigns “on tbe grounds of failure to comply with tbe terms of tbe lease, and abandonment for failure to develop with reasonable diligence."
