STOKES, Justice.
This is a compensation suit instituted by appellee, Lee Pruitt, to set aside the award of the Industrial Accident Board and to recover compensation for a period of 401 weeks for alleged total and permanent incapacity to labor by virtue of an injury received by him on July 10, 1941, while in the course of his employment with the Texas Creosoting Company for whom appellant was the compensation insurance carrier.
