This is an appeal from an order of the district court granting the defendant’s motion to dismiss the plaintiffs cause of action. The plaintiff secured a judgment for personal injuries sustained in an automobile accident against an intoxicated defendant. The judgment was paid. She now seeks by this action to secure additional compensation from the municipal tavern owner whose employees allegedly .sold the intoxicating liquor to the defendant in the first action.
