BLACKMUN, Circuit Judge.

This is an appeal from' the district court’s dismissal of four of five diversity *569causes of action asserted against two Minnesota villages operating municipal liquor stores. The suits are based upon the state’s Civil Damage (or “Dram Shop”) Act, Minn.Stat.Ann. § 340.95.1 The problem presetted is evidently one of first impression.
