MEMORANDUM AND ORDER
MORAN, District Judge.
Plaintiff Harold L. Mitchell, Jr. (“Mitchell”) filed this action against defendants Richard E. Tenney (“Tenney”), Pioneer Commodities, Inc. (“Pioneer”) and AgriEcon, Inc. (“Agri”) alleging a federal claim and various pendent state claims. Specifically, Mitchell contends that Pioneer and Tenney discriminated against him on the basis of his race in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq.
