McGOWAN, Circuit Judge:

This is an appeal from the District Court’s order (1) granting appellee’s motion to dismiss the complaint for lack of jurisdiction over the subject matter, and (2) denying appellant’s cross-motion for partial summary judgment. Both turn on the issue of whether appellant was an employee within the meaning of Title VII of the Civil Rights Act of 1964, as amended by the Equal Employment Opportunity Act of 1972 (the Act). 42 U.S.C. § 2000e-16 (Supp. II 1972).
