This matter is before the Court on cross motions for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Plaintiff Casco Indemnity Company (“Casco”) and defendant Rhode Island Inter-local Risk Management Trust (the “Trust”) seek to determine which of their respective insurance policies provides primary uninsured motorist coverage to defendant Victor Cipriano (“Cipriano”) for damages sustained as a result of an automobile accident on November 20, 1993.
