Plaintiff American States Insurance Company (“ASIC”) brought this action seeking a declaratory judgment that Defendant Joann LaFlam (“LaFlam”) is not entitled to uninsured/underinsured motorist (“UM”) benefits under a policy issued to LaFlam’s employer (the “Policy”) because the contractual limitations period has expired. LaFlam filed a counterclaim against ASIC, alleging breach of contract, bad faith, and declaratory judgment; she also seeks a declaratory judgment that ASIC is contractually obligated to pay her claim.
