Colby, District Judge.

The action was brought to recover damages on account of the overflow of plaintiff’s lands, alleged to be due to the negligent construction and maintenance of a drainage system through and near the lands of plaintiff.

The facts in general appearing of record are that the defendant and appellant is a corporation organized under the name of the Elkhorn Yalley Drainage District in the year 1909, authorized by the provisions of chapter 153, Laws 1907, and later laws amendatory thereof and supplementary thereto, for the purpose of constructing ditches and controlling surface…
