Holt, J.,

delivered the opinion of the court..This is an attachment brought by Mrs. J. L. Ratliff, administratrix of her husband, J. L. Ratliff, deceased, against John Jewell and his wife, Esther Jewell, to enforce the collection of two notes executed by these defendants, both of date November 3, 1926; one for *319$153.00, due April 3, 1927, and one for $150.00, due November 3, 1927. In each a ten per cent attorney’s fee is provided for.

A plea of set-off was interposed. That plea, among •other things, states that:
