This is an action of assumpsit brought by the Atlantic Coast Realty Company, a North Carolina corporation, doing business in Virginia, against the executor of Wirt Robertson, to recover damages for the breach of an alleged parol contract whereby the plaintiff was to have the exclusive privilege of selling a tract of 418 acres of land of Robertson for a stipulated compensation. Action was first brought in the United States District Court, at Richmond, against Robertson in his lifetime.
